2. Scope of application, definitions
2.1 The following General Terms and Conditions (GTC) apply to all contracts that a consumer or an entrepreneur concludes with us via the product offers presented in the online shop.
2.2 A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.
3. Conclusion of contract
3.1 Our product offers in the online shop represent a binding offer to order goods from us.
3.2 You accept our offer of a contract for the products in the shopping basket by clicking on the "Order subject to payment" button at the end of the ordering process. With this contractual declaration, the purchase contract is concluded.
3.3 You will receive a confirmation of receipt by e-mail immediately after receipt of your order.
4. Prices, shipping costs
4.1 All prices stated in the online shop are total prices. The total prices include all price components including the applicable statutory VAT.
4.2 Germany Shipping costs: 4,95 € | We charge the costs for packaging and shipping (shipping costs) separately. From a value of goods of € 50.00 deliver within Germany free of shipping costs.
4.3 Austria Shipping costs: 6,90 € | From a value of goods of € 99,00 we deliver to Austria free of shipping costs.
5. Terms of payment
We offer the following payment options:
> By advance payment by bank transfer
We will send you our bank details by e-mail. When transferring the invoice amount, please state your full name and the order number as the purpose of payment. The invoice amount is due immediately after receipt of the bank details.
> By PayPal
To use the payment service PayPal you need a PayPal account. You log in to PayPal with your access data or open a new PayPal account and confirm the payment instruction for the invoice amount.
Payment by PayPal PLUS direct debit and credit card (PayPal account not required)
> Payment by direct debit (PayPal PLUS)
With the confirmation of the payment order you give PayPal a direct debit mandate. PayPal will inform you about the date of the debit. Further information as well as the General Terms and Conditions of PayPal can be foundhere .
> Payment by credit card (PayPal PLUS)
If you choose the credit card payment method, a PayPal account is not required and does not need to be opened. PayPal accepts the following credit cards: MasterCard, Visa, American Express, Discover, Diners Club. Your credit card information is encrypted and securely transmitted to PayPal. For payment by credit card you need the 16-digit card number, the validity period of the credit card and the check digit.
Payment processing is carried out by your credit card company at PayPal's request immediately after confirmation of the payment instruction and your legitimation as a legitimate cardholder. The card settlement is carried out by PayPal.
> Payment by PayPal direct debit or credit card (PayPal account required)
After completing your order, you will be redirected in encrypted form to an external page of our payment service provider PayPal. To use the payment method PayPal direct debit or credit card you need a PayPal account. You log in to PayPal with your access data or open a new PayPal account and confirm the payment instruction for the invoice amount. PayPal accepts the following credit cards: MasterCard, Visa, American Express, Discover, Diners Club.
There are no additional costs for this payment method, except for exchange rate fees if the payment is made in a currency other than EUR or if your credit card company charges additional fees.
> Redeeming Promotional Coupons (Vouchers)
We issue promotional coupons with a predetermined validity period as part of promotional activities. Our promotional coupons can only be redeemed during the specified period and only once as part of an order process. We reserve the right to link the possibility of redeeming promotional coupons to a minimum order value.
The value of the order must be at least equal to the amount of the promotional coupon. A difference to a higher value of goods can be compensated with the payment options offered by us. The value of a promotion coupon cannot be paid out in cash. The value of the promotional coupon will also not be refunded if all or part of the ordered goods are returned.
Promotional coupons can only be redeemed prior to the completion of an order transaction. A subsequent crediting is unfortunately not possible. The promotion coupon cannot be transferred to third parties. Several promotional coupons cannot be combined with each other, unless we have agreed otherwise.
If you have redeemed a promotional coupon and return goods within the scope of the statutory right of withdrawal, we reserve the right to charge you the original price for the goods that you did not return. This only applies if the value of the order, after deduction of the returned goods, falls below or equals the respective value of the promotional coupon/minimum order value.
6. Delivery area and delivery times
6.1 We only deliver within Germany and to Austria quickly and reliably through our partner DHL (Deutsche Post AG) to the delivery address provided by you. The delivery time within Germany is approx. 1-3 working days, to Austria approx. 3-6 working days.
6.2 When paying in advance, you issue a payment order to your payment service provider (e.g. bank, PayPal). The delivery period begins on the day following the payment order to your payment service provider. If the end of the period falls on a Saturday, Sunday or a state-recognised public holiday at the place of delivery, the next business day shall be decisive for the end of the period.
7. Retention of title
The goods remain our property until full payment has been made.
8. Statutory Right of Withdrawal
The statutory right of withdrawal exists exclusively for consumers within the EU member states. For the definition of a consumer, section 2.2 of these terms and conditions applies.
9. Legal liability for defects
You are entitled to the legal claims for defects for products purchased from us.
10. Applicable law, place of jurisdiction
10.1 The law of the Federal Republic of Germany shall apply to the conclusion and performance of all contracts, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In the case of consumers, this choice of law shall only apply insofar as the protection granted is not restricted by mandatory provisions of the law of the state in which the consumer has his habitual residence.
10.2 In business transactions with merchants and legal entities under public law, our place of business shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The same shall apply if an entrepreneur does not maintain a general place of jurisdiction in Germany or if his place of residence and/or habitual abode is unknown at the time the action is brought. Our right to call upon the court at another legal place of jurisdiction remains unaffected by this.
The EU Commission provides an interactive website for online dispute resolution (ODR platform). The ODR platform is a central contact point for consumers and entrepreneurs who wish to settle disputes arising from online legal transactions out of court.
We are not obliged to participate in an arbitration procedure and does not offer participation in such a procedure.
B. Customer information
1. Individual technical steps leading to the conclusion of the contract
The ordering process in our online shop takes place via labeled and self-explanatory buttons, which are activated with a mouse click. In order to submit a binding contractual declaration, you must go through the following technical steps:
- Placing the item in the shopping cart
- Logging in to the online shop with an existing customer account (user name/password), registering as a new customer and entering your personal data or ordering as a guest
- Selecting the delivery address
- Selecting the payment method
- Confirming the General Terms and Conditions
- Summarizing all order data
- Submitting your contractual declaration, which leads to the conclusion of the contract.
2. Storage and retrieval of the contract text after conclusion of the contract
The text of the contract is stored by us. You can call up the text of the contract (such as product descriptions, general terms and conditions and customer information) during the ordering process and print and archive it using the print function of your Internet browser. Immediately after your order, we will send you a confirmation of receipt with the data of your order and the terms of contract, which you can print out and save.After conclusion of the contract, the contract text can no longer be accessed in our online shop. If you have registered a customer account, your orders will be archived under "My account / My orders".
3. Recognition and correction of input errors in the ordering process
You can detect input errors at any time during the ordering process because your entries are immediately saved and visible on the screen. In the event of input errors, please use the labeled and self-explanatory buttons that we provide for you in the ordering process to correct input errors. On the final order page, you can check and correct all order data again before submitting your contractual declaration.
4. Language available for the conclusion of the contract
Contracts in our online shop are concluded exclusively in German.
